1. General provisions: These general terms and conditions apply to all equipment rentals by BUBBLE EVENT, avenue Fond Roy 118, 1180 Uccle, VAT BE0566891259. They are also available on the website https://www.bubbleevent.be/. Unless otherwise agreed in writing, the renter’s general terms and conditions, even if communicated, shall be deemed inapplicable insofar as they differ from these terms and conditions. By placing an order, the renter acknowledges having read these general terms and conditions and accepts them without reservation.

2. Prices: Rental prices are available on the website https://www.bubbleevent.be/ and are stated in EURO, excluding 21% VAT. BUBBLE EVENT reserves the right to amend its prices at any time, it being understood that the price applicable at the time the order is placed shall apply. The prices offered are valid for a period of three working days, including the day of collection or delivery and the day of return or collection by BUBBLE EVENT. Beyond this period, the rental price will be subject to a quotation. If the rented goods are not returned at the end of the agreed rental period, the rental shall automatically be renewed for successive periods of the same duration as the initial rental period. However, BUBBLE EVENT may terminate the agreement by notifying the renter of its intention to recover possession of the rented goods at the end of the current rental period.

3. Transport and delivery: The renter may choose to collect and/or return the rented goods themselves. In this case, loading and unloading, transport and assembly/disassembly of the rented goods shall be at the renter’s expense and risk. All collections and returns must take place on a working day during BUBBLE EVENT’s opening hours. The rented goods may also be delivered and/or collected by BUBBLE EVENT for an additional fee. In this case, the renter undertakes to receive the rented goods at the place and time agreed with BUBBLE EVENT. Failing this, BUBBLE EVENT may return the goods to its premises at the renter’s expense. The renter also undertakes to ensure that the rented goods are accessible and ready for loading at the place and time agreed with BUBBLE EVENT for their collection. Otherwise, a second transport charge will be invoiced. The delivery and collection fee includes 15 minutes for unloading and 15 minutes for loading by one person. Any additional work will be invoiced according to the rates stated on the website https://www.bubbleevent.be/. BUBBLE EVENT accepts no liability for delays in delivery, particularly in the event of loss of equipment or strikes.

4. Rented goods: BUBBLE EVENT undertakes to fulfil orders subject to stock availability. The rented goods are deemed to have been delivered in perfect condition and in the quantities stated on the delivery note. The rented goods may only be used by the renter with the accessories supplied by BUBBLE EVENT. BUBBLE EVENT retains ownership of the rented goods at all times, including in the event of the renter’s bankruptcy. No modifications may be made to the rented goods.

5. Return of rented goods: The rented goods must be returned in the same condition in which the renter received them and, where applicable, in the packaging provided for this purpose. Any rented item that is not returned, is damaged or is returned in a condition that makes it unfit for use, whatever the cause, including theft, fire or any other event, will be invoiced at its replacement market value plus 15%. The counting and qualitative inspection of the rented goods (the “Inspection”) shall be carried out by BUBBLE EVENT. The renter may request a joint Inspection by sending an email before the end of the rental period. Otherwise, the renter shall be deemed to accept the Inspection carried out by BUBBLE EVENT. The costs associated with a joint Inspection will be invoiced at the applicable labour rate if it ultimately shows that the goods comply with the delivery note, both in terms of quantity and condition.

6. Payment terms: Unless otherwise agreed, the rental price must be paid before the rented goods are collected or delivered. The rental price includes (i) the rental price of the goods in accordance with Article 2, (ii) where applicable, the transport and delivery charges in accordance with Article 3, and (iii) the amount of the security deposit payable by the renter to BUBBLE EVENT in accordance with BUBBLE EVENT’s proposal, with a minimum amount of €200. If full payment is not received, BUBBLE EVENT shall be entitled to refuse to release the rented goods. In the event of any breach of the renter’s obligations, or in the event of termination of the rental agreement, BUBBLE EVENT reserves the right to retain the security deposit, without prejudice to its right to claim compensation for any loss or damage suffered. Any modification to an order within 48 hours before delivery may be subject to an additional charge. Invoices are payable immediately and in full. An additional administrative fee of €5.50 excluding VAT will be charged for every invoice. Unless disputed by registered letter within 10 days of the invoice date, invoices shall be deemed to have been definitively accepted by the renter. Any amount not paid by the due date shall automatically and without prior notice bear contractual interest at a rate of 10.5% per commenced month of delay. In addition to this interest, any amount unpaid by its due date shall automatically be increased by a fixed and irreducible compensation of 15%, with a minimum of €125.

7. Liability: The renter acknowledges having been informed of the safety rules to be observed when installing and using the rented goods. The renter expressly and irrevocably releases BUBBLE EVENT from any liability in the event of an accident. The renter shall be responsible for any theft, damage or destruction affecting the rented equipment. It is the customer’s responsibility to take out the necessary insurance to cover these risks.

8. Cancellation: In the event of cancellation of an order between 5 and 3 working days before delivery, compensation equal to half of the invoiced amount shall be payable to BUBBLE EVENT. In the event of cancellation less than 3 working days before delivery, this compensation shall be equal to the full invoiced amount, excluding any transport costs. Any non-use of all or part of the rented goods shall under no circumstances release the renter from the obligation to pay the rental price.

9.
